Terms of Use
These terms are the agreement between you and Tiger Koi LLC ("we", "us") for using tigerkoi.com and the Tiger Koi apps: Meet, Music and Memory (together, "the service"). By creating an account or using the service you accept them. If you do not agree, do not use the service.
1. Accounts and access
- You must give a working email address and keep your password private. You are responsible for what happens under your account.
- Access is by application or invitation. We decide which apps an account may use and may change or withdraw access at any time, with or without a reason.
- You must be at least 13 years old to hold an account. If you are under 18, a parent or guardian must agree to these terms for you.
- One person per account. Do not share or transfer your account.
2. Acceptable use
Use the service lawfully and considerately. You must not:
- Record or share a meeting in a way that breaks the law where you or the other participants are. Meet shows a recording indicator to everyone; participating in a meeting while that indicator is shown means you have been told it is being recorded.
- Upload content you have no right to use, including sheet music under copyright that you are not permitted to copy.
- Harass, threaten or impersonate anyone, or send spam.
- Try to break into the service, probe it for weaknesses, overload it, or bypass access controls or limits.
- Use automated tools to scrape or bulk-download content.
3. Your content
Whatever you upload, record, write or create in the service stays yours. You give us only the permission needed to store, process and show it back to you and to the people you share it with (for example, the other participants of a recorded meeting). We do not use your content for anything else, and we do not use it to train machine-learning models.
You are responsible for your content and for having the rights to it. We may remove content or suspend an account that breaks these terms or the law.
4. Our service
Tiger Koi is a small service run by a small company. We do our best to keep it running and to keep your data safe, but we provide the service "as is", without warranties of any kind. We may change, pause or stop any part of the service. Where we can, we will give notice and a way to export your data before removing anything.
The service may use third-party providers (listed in the Privacy Policy). Their availability is outside our control.
5. Limitation of liability
To the fullest extent the law allows, Tiger Koi LLC is not liable for indirect, incidental or consequential damages, loss of data, or loss of profits arising from your use of the service. Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim, or 50 US dollars if you paid nothing. Some jurisdictions do not allow these limits, in which case they apply as far as permitted.
6. Ending the agreement
You may stop using the service and ask us to delete your account at any time (see the Privacy Policy). We may suspend or close your account if you break these terms, if the law requires it, or if we stop offering the service. Sections 3, 5 and 7 continue to apply after the agreement ends.
7. Governing law
These terms are governed by the laws of the State of New York and the United States, without regard to conflict-of-law rules. Disputes will be handled in the state and federal courts located in Albany County, New York, unless the law gives you the right to use the courts where you live.
8. Changes to these terms
We may update these terms. For material changes we will email account holders at least 14 days before they take effect. Continuing to use the service after that date means you accept the new terms.
